concerning how Bulger Capital will respond to events that significantly
disrupt the Firm’s business. Since the timing and impact of
disasters and disruptions is unpredictable, the Firm will have to be
flexible in responding to actual events as they occur. With that in
consideration, Bulger Capital is providing you with this information on
the Firm’s business continuity plan.

Bulger
Capital’s
Business Continuity Plan
Bulger Capital plans to quickly recover and resume business operations
after a significant business disruption and respond by safeguarding
Bulger Capital’s employees and property, making a financial and
operational assessment, protecting the Firm’s books and records,
and allowing Bulger Capital’s customers or clients to transact
business. Bulger Capital’s business continuity plan is designed
to permit the Firm to resume operations as quickly as possible, given
the scope and severity of the significant business disruption.
Bulger Capital’s business continuity plan
addresses: data back up and recovery; all mission critical systems;
financial and operational assessments; alternative communications with
customers, clients, employees, and regulators; alternate physical
location of employees; critical supplier, contractor, bank and
counter-party impact; regulatory reporting; and assuring Bulger
Capital’s customers prompt access to their funds and securities
if Bulger Capital is unable to continue the Firm’s business.
Varying
Disruptions
Significant business disruptions can vary in their scope, such as only
Bulger Capital, a building housing Bulger Capital’s business, the
business district where Bulger Capital is located, the city where
Bulger Capital is located, or the whole region. Within each of these
areas, the severity of the disruption can also vary from minimal to
severe. In a disruption to only Bulger Capital or the building housing
the Firm, Bulger Capital’s operations will be transferred to a
local alternate location and it is expected that Bulger Capital should
be able to recover and resume business within several hours. In a
disruption affecting Bulger Capital’s business district, city, or
region, the Firm will transfer its operations to a site outside of the
affected area, and plans to recover and resume business within a one or
two week period. In either situation, Bulger Capital intends to
continue in business and notify you through the Firm’s web site,
www.bulgercapital.com how to contact Bulger Capital.
